I - LEGAL NOTICES

The website www.mya-bay.com (the “Site”) is published by the company TB Style SRL , whose registered office is located at Avenue du Hêtre 2 – 4000 Liège, Belgium , registered in the Brussels Trade and Companies Register under number 847 178 204 , intra-community VAT number BE0847 178 204 (hereinafter “TB Style”).

II - APPLICATION OF THE GENERAL CONDITIONS OF SALE

These General Terms and Conditions apply to all sales of Products offered on the Site.
The Customer declares to have read these General Terms and Conditions and to have accepted them without reservation before placing an order.

The applicable T&Cs are those in force on the Site on the date the order is validated.
TB Style reserves the right to modify its T&Cs at any time.

III - ACCESSIBILITY OF THE SITE

The Site is accessible 24/7, except for interruptions for maintenance or force majeure. TB Style does not guarantee uninterrupted availability and declines all liability in the event of unavailability or technical bugs.

IV - CUSTOMER REGISTRATION

The Customer can order by creating an account or using the quick login options (Facebook, Google or Guest mode). He/she guarantees to be of legal age and legally capable.

TB Style reserves the right to delete any account that does not comply with the T&Cs.

V - PRODUCTS

The Products are those described on the Site on the day of consultation.
Despite the care taken, errors may occur. In the event that a Product is unavailable after an order has been placed, the Customer will be informed.

VI - ORDER

Validation of an order implies full acceptance of these T&Cs.
A confirmation email summarizing the order will be sent.

Invoices are available in the “My Account” section.

VII - REFUSAL OF ORDER

TB Style may refuse an order in the event of a prior dispute, suspicion of fraud or unavailability of the Product.

VIII - PRICE AND PAYMENT

Prices are displayed in euros (VAT included).
Customs charges for deliveries outside the EU are the responsibility of the Customer.

Payment is made in cash at the time of ordering, via secure means:

Shopify Payments (credit card, Apple Pay, etc.)
PayPal

TB Style never has access to the Client's banking data.

IX - DELIVERY

Delivery is provided by third-party providers (Bpost, Colissimo, FedEx, DPD, DHL, etc.) depending on the options selected.

Indicative timeframe:

Belgium / France: 12 working days max.
International: 20 working days max
During periods of high activity (November - December, collection launch): +10 days

Delays related to the carrier or cases of force majeure do not give rise to any compensation beyond the possible reimbursement of the Product.

X - RIGHT OF WITHDRAWAL

The Customer has 14 days to exercise his right of withdrawal.
The return must be made in its original packaging, unworn, at the Customer's expense.

A flat-rate deduction of €2.50 is applied to refunds for returns from the EU.

Personalized jewelry cannot be returned or exchanged.

XI - LEGAL GUARANTEES

In accordance with Belgian law, the Products benefit from:

of the legal guarantee of conformity (1 year)
of the guarantee against hidden defects (notification within 3 days)

TB Style undertakes to refund or replace the defective Product.
Excluded: Products modified or damaged by the Customer.

XII - RESERVATION OF OWNERSHIP

The Products remain the property of TB Style until full payment of the price.

XIII - RESPONSIBILITY

TB Style's liability is limited to the amount of the order.
No compensation is due in the event of:

data loss
technical bug
moral or financial damage

The Client is responsible for its IT security.

XIV - FORCE MAJEURE

In the event of force majeure (strike, war, disaster, network failure, etc.), the performance of contractual obligations may be suspended or terminated.

XV - PERSONAL DATA & COOKIES

The Site respects the privacy of its users.
The data is used only for order processing and is never resold.

The Site uses cookies, with the user's consent, to improve the browsing experience.

XVI - APPLICABLE LAW AND JURISDICTION

The T&Cs are subject to Belgian law .
In the event of a dispute, the competent courts will be those designated by law.

XVII - PATRONAGE PROGRAMS

TB Style is involved in charitable projects through certain collections.
The amounts paid do not give rise to a tax reduction for the Client.
